Search4Solar – Terms and Conditions

Article 1 – Nature of the Platform (Marketplace & Intermediary Role)

• Search4Solar operates as an online marketplace and commercial intermediary connecting customers with third-party vendors (manufacturers, distributors, or suppliers).
• Search4Solar facilitates transactions, processes payments from customers, and settles payments to vendors on a back-to-back basis.
• Unless explicitly stated otherwise, Search4Solar does not manufacture, own, or physically hold stock of the products offered on the platform.
• The purchase agreement is concluded between the customer and Search4Solar. Search4Solar, in turn, procures the relevant products from the vendor to fulfill the order.
• Search4Solar acts in its own name but relies on third-party vendors for the performance of the agreement (including supply, delivery, and product conformity).

Article 2 – Products

• Products offered include solar panels, inverters, and other sustainable energy-related equipment.
• Product descriptions, specifications, and availability are provided by vendors. Search4Solar does not guarantee their accuracy or completeness.
• Manufacturer or supplier warranty conditions apply directly between you and the vendor or manufacturer.

Article 3 – Registration

• You must register an account to place orders.
• You are responsible for ensuring that your account information is accurate and up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Search4Solar is not liable for unauthorized use of your account.

Article 4 – Payments

• All payments are processed through the Search4Solar platform or provided Pro Forma Invoice.
• Prices are displayed in the online store and exclude VAT as specified.
• Payment methods may include online payment options or invoice-based payment subject to credit approval.
• Search4Solar may act as a payment intermediary on behalf of the vendor.
• Shipping costs are borne by the customer unless stated otherwise.

Article 5 – Delivery

• Products are delivered directly from the vendor or its logistics partners to the customer.
• Delivery times are indicative and based on information provided by the vendor.
• Search4Solar depends on vendor performance and therefore does not guarantee exact delivery times.
• Search4Solar shall not be liable for delays, non-delivery, or incomplete delivery caused by vendors or third-party logistics providers, except where required by mandatory law.

Article 6 – Returns

• Returns must be requested within 14 days after receipt via the platform or via sales@search4solar.com.
• Returns are handled in coordination with the vendor and subject to vendor acceptance and inspection.
• Search4Solar acts as an intermediary in the return process and depends on the vendor’s confirmation for refunds.
• Returns need to be in undamaged original packaging.
• A handling fee of 5% of the total order value applies unless otherwise agreed.
• Return shipping costs are borne by the customer.
• Custom-made or specially procured products cannot be returned.
• Refunds are processed after the vendor has received and approved the returned goods and refunded Search4Solar.

Article 7 – Cancellation Policy

• Cancellation of an order is only possible before it has been processed.
• Cancellation requests must be submitted via the platform or in writing to sales@search4solar.com.
• A cancellation fee of 5% (minimum €25) applies unless otherwise agreed.
• For custom or specially sourced products, full costs apply once processed by Search4Solar.

Article 8 – Liability

• Search4Solar is responsible for processing orders and payments but relies on third-party vendors for the actual supply and delivery of products.
• To the maximum extent permitted by law, Search4Solar shall not be liable for:
  • Non-performance or breach by the vendor
  • Non-delivery or delayed delivery
  • Product defects, shortages, or non-conformity
• Any product-related claims (including warranty claims) must ultimately be addressed to the vendor or manufacturer. Search4Solar will provide reasonable assistance in facilitating such claims.
• Search4Solar’s liability, if any, is limited to the amount paid by the customer for the relevant order.
• Nothing in these terms excludes liability that cannot be excluded under applicable law.

Article 9 – Platform Use and Transactions

• All offers, negotiations, and agreements must take place through the Search4Solar platform.
• Circumventing the platform to transact directly with vendors introduced via Search4Solar is prohibited.
• Search4Solar reserves the right to suspend or terminate accounts in case of misuse.

Article 10 – Privacy

We process personal data in accordance with the GDPR. Please refer to our Privacy Policy for full details.

Article 11 – Intellectual Property

All intellectual property rights related to the platform, content, and materials belong to Search4Solar or its licensors. Unauthorized use is prohibited.

Article 12 – Complaints

• Complaints can be submitted via sales@search4solar.com.
• We will handle your complaint as quickly as possible, within a maximum of 7 days of receiving it. If more time is needed to resolve it, you will receive a confirmation within 2 days with an estimated response date.
• Search4Solar will mediate between customer and vendor where possible but is not responsible for final resolution.

Article 13 – Dispute Resolution

• These Terms are governed by Dutch law.
• Disputes shall be submitted to the competent court in Rotterdam.
